Contract
Please review the Terms and Conditions carefully, including all brochures, documents, correspondence, and those of our suppliers. These terms form the basis of our contract with you. Ensure you have read and understood these Terms and Conditions before booking and address any questions you may have. By confirming your booking, you accept all the Terms and Conditions outlined below and acknowledge that you have read them.
For group bookings, the group leader must share these Terms and Conditions with all group members and is financially responsible for the booking. We are not liable if the group leader fails to do so.
You confirm that: (a) you are of legal age and capable of creating binding obligations, (b) you are authorized to act on behalf of those you represent, and (c) the information provided by you and your group is accurate.
Violating these Terms and Conditions may result in: (a) cancellation of your reservation or purchase, (b) forfeiture of any payments made, and (c) denial of access to the travel services.
Uncharted America reserves the right to cancel trips or upgrade passengers to more expensive tours. In case of a partial cancellation, unused expenses may be refunded.

COVID-19 Release of Liability
By booking a tour, you acknowledge the risk of exposure to COVID-19 and assume responsibility for yourself and any minors traveling with you. Exposure to or infection by COVID-19 may result in personal injury, illness, disability, or death. Such risks are inherent in travel and cannot be controlled or eliminated by Uncharted America.
You acknowledge that travel plans may be affected by closures, quarantine requirements, or vaccination mandates, and refunds may not be provided. You are responsible for understanding these requirements. You may need travel insurance for coverage related to COVID-19.
You, on behalf of yourself and any minors with you, release and hold harmless Uncharted America and its affiliates from any claims related to COVID-19, including exposure, infection, or travel restrictions, whether caused by negligence or otherwise, to the fullest extent permitted by law. This release survives any termination or cancellation of this Agreement.

Booking / Payment
To book, contact us via email, phone, or through our website. Your booking is confirmed upon receipt of the completed registration form. After booking, you will receive an itinerary, invoice, and travel information. Deposits are non-refundable unless specified otherwise. Upon payment, you will receive a receipt and checklist. Review all documents carefully, as we are not responsible for errors.

Credit Card Bookings
We accept major credit cards including Visa, Mastercard, American Express, and Discover. Before initiating a chargeback, contact us to discuss any concerns. We may dispute improper chargebacks and recover associated costs, including attorney fees. Improper chargebacks include those for non-cancellable reservations, unauthorized charges, or disagreements with our cancellation policy.

Force Majeure
Travel involves risks such as acts of God, terrorism, civil unrest, weather, and other unforeseen events. Uncharted America is not liable for losses or damages resulting from these events. In a force majeure situation, we will not refund any money but will refund any amounts recovered from suppliers.
You acknowledge the risks associated with the activity and authorize Uncharted America to arrange emergency medical treatment if necessary. You are responsible for having adequate insurance or bearing costs yourself.

Cancellation
We reserve the right to cancel or reschedule departures for any reason. If we cancel, except for force majeure, we will offer alternate arrangements or travel vouchers. Additional costs for air tickets or other travel arrangements not made by us are your responsibility. Changes to itineraries or transportation do not constitute material changes and do not qualify for cancellation. No Refund for Unused Arrangements
No refunds are provided for unused portions of a travel booking. Cancellations during the trip do not entitle you to a refund for unused portions.

Travel Protection
We advise obtaining travel insurance, including cancel-for-any-reason coverage, to protect against unforeseen travel issues. Uncharted America acts as an independent agent and is not responsible for the services or negligence of third-party suppliers, including tour companies.

Liability Disclaimer
Uncharted America is not liable for any loss, injury, or damage arising from third-party services, including transportation, accommodations, or activities. We are not responsible for personal property or delays caused by unforeseen circumstances. We reserve the right to refuse any traveler at our discretion.

Governing Law
This Agreement is governed by the laws of the State of Nevada, U.S.A., and any legal action must be brought in Clark County, Nevada.

Class Action Waiver / Limitation of Damages / Notice of Claim
Claims against Uncharted America must be brought individually, not as part of a class action. We are not liable for punitive damages, and any claim must be filed within 30 days of the trip or cancellation.

Entire Agreement & Severability
This document constitutes the entire agreement. If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

Photographic / Video Likeness
You consent to Uncharted America publishing photos or videos of the trip without further consent or compensation. You release Uncharted America from liability related to such use.

SMS / Email Communication
By booking or contacting Uncharted America, you opt in to receive SMS and email communications regarding your tour.

Minor Children
As a parent or guardian, you consent to your minor child's participation in the tour and agree that all terms apply equally to you and your child.
